Regulations of training in the field of occupational health and safety carried out by Sela Sp. z o. o. and Centrum Szkoleń Sela Sp. z o.o.

§ 1 GENERAL PROVISIONS

  1. The subject of the Regulations is to define the rules on which Centrum Szkoleń Sela Sp. z o. o. conducts training in the field of occupational health and safety, fire protection, principles of first aid, methodology of conducting on-the-job training, etc., through stationary training or training via electronic means of communication (on-line) for open and closed groups, as well as training in the form of e-learning through the website – znambhp.pl.
  2. Definitions
    • CONTRACTOR/ TRAINING ORGANIZER– Training Center Sela Sp. z o. o. with its registered office at ul. st. Kingi 5a, 65-215 Zielona Góra, registration number 2.08/00065/2015
    • PRINCIPAL/EMPLOYER– the entity with which the Contractor concluded a contract for the implementation of training or commissioned Centrum Szkoleń Sela Sp. z o. o. conducting the training
    • TRAINING PARTICIPANT– a person registered for training and notified about it by the Principal
    • TRAINING PROVIDER– a person on behalf of Centrum Szkoleń Sela Sp. z o. o. having the appropriate knowledge, professional experience and didactic preparation to ensure the proper implementation of training programs
    • TRAINING PROGRAM– a detailed training plan developed by the Employer or, in consultation with the Employer, by the training Organizer conducting training activities in the field of health and safety, based on framework training programs
    • TRAINING DOCUMENTATION– documentation confirming the course and completion of the training in accordance with the Regulation of the Minister of Economy and Labor of July 27, 2004 on training in the field of occupational health and safety (Journal of Laws No. 180, item 1860, as amended)
    • E-LEARNING PLATFORM– website of Centrum Szkoleń Sela Sp. z o. o. run at: www.znambhp.pl enabling training in the form of guided self-education
    • TEACHING RESOURCES/ MATERIALS– videos, equipment (e.g. phantoms, AED training devices), flipcharts, interactive boards, scripts, training materials, etc., materials contained on the e-learning platform www.znambhp.pl used for the training
    • GDPR– Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
  3. The Contractor and the Principal are obliged to comply with the provisions of the Regulations and to use the materials provided by the Customer in accordance with its intended purpose.

§ 2 TERMS OF PARTICIPATION

  1. The condition for participation in the training is to submit an application via the application form available on the website www.znambhp.pl or in the form of an e-mail and accept these regulations. Applications in the form of a telephone are also accepted, but then must be confirmed by e-mail. Ordering training is tantamount to reading and accepting the content of these Regulations.
  2. Mandatory training (i.e. occupational health and safety training) is exempt from VAT. Other trainings will be subject to VAT in the amount in accordance with applicable law. Before deciding on the training, the interested person is always informed about the final price of the training.
  3. Payment for stationary training and training in the form of teleconference should be made to the bank account indicated on the invoice, not later than within 7 days from the date of its issue.
  4. Payments for trainings conducted via the e-learning platform www.znambhp.pl, based on an invoice sent to the Customer’s e-mail address, should be made to the bank account indicated on the invoice. Confirmation of payment must be presented to the Contractor before the start of the training.
  5. In the title of the transfer, enter the invoice number of the purchased training.

§ 3 STATIONARY TRAINING

  1. The Contractor declares that he conducts training for companies in the field of occupational health and safety, fire protection, principles of first aid, methodology of conducting workplace training and other related in accordance with the current legal status, as well as based on knowledge, experience, good practices and using the latest training methods and teaching aids.
  2. The Organizer conducts training in the scope, dates and place agreed in detail with the Employer.
  3. The Organizer, in consultation with the Employer, develops training programs based on the Regulation of the Minister of Economy and Labor of July 27, 2004 on training in the field of occupational health and safety (Journal of Laws 2004 No. 180, item 1860, as amended) and adapts them to the needs, specificity and adopted rules and methods of work based on the materials provided by the Employer.
  4. The training price includes:
    • organization and conduct of training, which is the subject of the contract
    • training materials provided
    • conducting an exam which is a theoretical and practical test of knowledge covered by the training program and the ability to perform or organize work with the use of
    • training content
    • issuing certificates confirming the completion of training
    • providing full training documentation.
  5. Participants of the training are required to actively participate in the entire training, as well as to behave in accordance with the principles of personal culture and generally accepted social norms. In the event of inappropriate behavior of a participant of the training, which makes it difficult to conduct it, the trainer has the right to exclude him from the further part of the training.
  6. Participants are obliged to use the teaching aids used for the purposes of the training in a manner consistent with their intended purpose, at the time and in accordance with the instructions provided by the Training Provider.
  7. Material responsibility for the destruction of teaching aids used for the purposes of the training by using them in a manner inconsistent with the instructions of the Trainer rests with the Training Participant.
  8. Participation in only part of the training does not entitle the training Participant to take the examination.
  9. Participation in part of the training resulting in the inability to take the test exam disqualifies the Participant of the training, while preventing the Contractor from fulfilling §3.4 of the Training Regulations. This situation does not release the Principal from the training fee.
  10. 10. A duplicate of the certificate is issued at the Principal’s written request sent by e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl , after paying a fee of PLN 20 net + VAT for 1 duplicate to the Contractor’s account on the basis of an invoice issued (the price includes the cost of the certificate, employee labor costs, registered mail shipping costs).

§ 4 TRAINING IN THE FORM OF PHONE CONFERENCE

  1. The Contractor declares that he conducts training for companies in the field of occupational health and safety, fire protection, principles of first aid, methodology of conducting workplace training and other related in accordance with the current legal status, as well as based on knowledge, experience, good practices and using the latest training methods and teaching aids via electronic means of communication (on-line teleconference).
  2. The Organizer conducts training in the scope, dates and place agreed in detail with the Employer.
  3. The Organizer determines, in consultation with the Employer, a convenient form of establishing an on-line connection for the duration of the training in the form of a teleconference.
  4. The selection of the means of electronic communication, type of options and possible additional costs of using external platforms will be determined on the basis of consultations between the parties.
  5. The Organizer, in consultation with the Employer, adapts the training programs to the needs, specificity and adopted rules and methods of work based on the materials provided by the Employer.
  6. The training price includes:
    • organization and conduct of training, which is the subject of the contract
    • sending information / invitations to training
    • training materials provided
    • conducting an exam which is a theoretical and practical test of knowledge covered by the training program and the ability to perform or organize work with the use of
    • training content
    • issuing certificates confirming the completion of training
    • providing full training documentation
  7. Participants of the training are required to actively participate in the entire training, as well as to behave in accordance with the principles of personal culture and generally accepted social norms. In the event of inappropriate behavior of a participant of the training, which makes it difficult to conduct it, the trainer has the right to exclude him from the further part of the training.
  8. Participants are obliged to use the teaching aids used for the purposes of the training in a manner consistent with their intended purpose, at the time and in accordance with the instructions provided by the Training Provider.
  9. Participation in only part of the training does not entitle the training Participant to take the examination. In the event of connection disruptions that make it difficult to understand the transmitted content, the training should be repeated. The condition for repeating the training is to report this fact to the instructor immediately.
  10. Participation in part of the training resulting in the inability to take the test exam disqualifies the Participant of the training, while preventing the Contractor from fulfilling §4.5 of the Training Regulations. This situation does not release the Principal from the training fee.
  11. A duplicate of the certificate is issued at the Principal’s written request sent by e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl , after paying a fee of PLN 20 net + VAT for 1 copy of the duplicate to the Contractor’s account, on the basis of an invoice issued (the price includes the cost of the certificate, employee labor costs, registered mail shipping costs).

§ 5 E-LEARNING TRAINING

  1. The condition for using the www.znambhp.pl platform is a connection to a stable Internet network.
  2. The Contractor declares that all content, audio and video materials, posters and other teaching aids used on the platform comply with the current legal status, and have been developed based on knowledge, experience, good practices and with the use of the latest training methods and teaching aids possible to be placed on the e-learning platform.
  3. The training price includes:
    • providing an e-learning platform on the website www.znambhp.pl providing access to the training which is the subject of the contract
    • training materials provided
    • the training organizer appoints an examination committee consisting of two teams – one on the side of the Principal, the other on the part of the Contractor
    • the exam is conducted in two ways:
      • on the part of the Contractor – the theoretical part of checking the knowledge covered by the training program, the result of which will be assessed on the basis of an algorithm developed by the examination committee on behalf of Centrum Szkoleń Sela Sp. z o. o
      • on the part of the Principal – the practical part of checking the ability to perform or organize work using the content of the training – the Principal is obliged to conduct the exam reliably
    • issuing certificates confirming the completion of training
    • providing full training documentation
  4. Participants of the training are required to actively participate in the entire training.
  5. Participants are required to take the examination on their own.
  6. The intellectual property rights to the materials contained on the website www.znambhp.pl are fully vested in the Contractor. Any copying, printing, as well as public display of the shared content is prohibited, unless it results from separate agreements or mandatory provisions of law. Legal measures may be taken in the event of non-compliance.
  7. The Principal is obliged to keep the login and password to his account on the website www.znambhp.pl secret. Within the limits resulting from the generally applicable provisions of law, the Principal is responsible for all activities related to the use of the login and password for a given account on the website, and the password is confidential information for the exclusive knowledge of the Principal.
  8. Taking into account the security of data processed within the service, after 20 minutes of user inactivity, the system is automatically logged out. The entered data and information are saved in the database, subject to their prior approval by the user.
  9. The Contractor reserves the right to carry out maintenance works that may cause difficulties in using the website www.znambhp.pl or temporarily prevent its use.
  10. The Contractor is not responsible for any possible inability to access the website www.znambhp.pl by the user, resulting, for example, from technical limitations of the equipment.
  11. The Contractor informs that the websites to which links can be found on the website www.znambhp.pl, unless they contain such information, have not been prepared by him. As a consequence, the Contractor bears no responsibility for the information, opinions and materials contained on these websites or websites linked to them.
  12. A duplicate of the certificate is issued at the Principal’s written request sent by e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl ), after paying a fee of PLN 20 net + VAT for 1 copy of the duplicate to the Contractor’s account, on the basis of the issued invoice (the price includes the cost of the certificate, employee’s labor costs, shipping costs by registered mail – additional shipping costs will be added for courier delivery).

§ 6 RESIGNATION FROM THE TRAINING BY THE ORDERER

  1. The training client has the right to resign from participation in the training, subject to the provisions contained in points 6.2 and 6.3 of this paragraph.
  2. Resignation from the participant’s participation in the training without incurring costs can only be done by e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl ), while the message regarding the resignation must reach the Contractor’s mailbox no later than 3 business days before the scheduled start date of the training.
  3. Resignation from the participation of a person registered less than 3 working days before the planned start date of the training results in the Ordering Party being charged with 80% of the gross costs of participation, provided that the Ordering Party informs the Service Recipient in writing only by e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl ) about resignation from the training. Lack of information in writing by the day and time of the beginning of the training results in charging the Principal in the amount of 100% of the participation costs.
  4. Launching the e-learning training on the website www.znambhp.pl results in the inability to resign from the training.

§ 7 CANCELLATION OF THE TRAINING BY THE CONTRACTOR

  1. The Contractor reserves the right to cancel the training, in particular, in the event of unforeseen random events or the lack of a sufficient number of participants.
  2. If the training is canceled by the Contractor, the payments made for the participation of persons in the training will be fully returned to the bank accounts from which they were paid within 7 working days from the date of cancellation of the training, unless the Contractor and the Principal agree on a different training date.
  3. The Contractor reserves the right to change the place of training within the town where the training takes place.
  4. Information about the change of the training location or its cancellation will be sent to the Customer’s e-mail address or by phone.

§ 8 COMPLAINTS

  1. The participant or the Principal notifying the participant is entitled to submit a complaint in connection with the course or quality of the training within 7 days from the date on which the training took place.
  2. Complaints may be submitted in writing to the Contractor’s address or in electronic form via e-mail (e-mail: Szkolenia@selabhp.pl , biuro@selabhp.pl ). It is recommended that the Participant or the Service Provider reporting the participant provide in the description of the complaint: information and circumstances regarding the subject of the complaint, the subject of the request and contact details of the complainant.
  3. The Contractor shall consider complaints immediately, no later than within 14 days from the date of its receipt. If the complaint cannot be considered within this period, the Contractor shall notify the complainant in writing about the reasons for the delay and the expected date of considering the complaint within this period.
  4. Each of the reported complaints is forwarded to the Substantive Manager and serves to increase the quality of services provided.

§ 9 PRIVACY POLICY

  1. Sela Training Center Sp. z o. o. processes information on Service Providers, including information having the nature of personal data, in compliance with applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of personal data individuals in connection with the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) with the application of the safeguards required by law. Providing personal data is voluntary, but necessary to use the separate resources of the www.znambhp.pl platform and the services offered.
  2. The Principal has the right to access their personal data, the right to correct and supplement them, and the right to request the cessation of data processing and their removal, by addressing the Contractor in writing: by e-mail ( training@selabhp.pl , biuro@selabhp.pl ). In the event of deletion of the data conditioning the use of the separate resources of the website www.znambhp.pl and the services offered within its framework, the Customer loses the ability to use them.
  3. The administrator of the Principal’s personal data provided when creating an account or placing an order in the scope of: name, surname, address, e-mail address, telephone number, NIP is Centrum Szkoleń Sela Sp. z o. o. Personal data provided when creating an account or placing an order will be processed for the purposes of: execution and handling of the order pursuant to art. 6 sec. 1 lit. b) GDPR, which indicates that the processing is necessary to perform the contract concluded on the basis of the Regulations marketing of own products pursuant to art. 6 sec. 1 lit. f) GDPR, i.e. legitimate interests pursued by the Administrator. In the event of consent to receive the Newsletter, the data is also processed for the purpose of sending the Newsletter (the basis for processing is Article 6(1)(a) of the GDPR, i.e. the consent of the data subject).
  4. The recipient of personal data will be entities cooperating with the Administrator, which support him in his daily activities, providing in particular IT and accounting services.
  5. Personal data of the trainees (such as: name and surname, date of birth, e-mail address, job title) provided for the purpose of completing and handling the order will be stored for the period: in the case of stationary training and training in the form of a teleconference – until the date of validity of the training in accordance with the Regulation of the Minister of Economy and Labor of 27 July 2004 on training in the field of occupational health and safety (Journal of Laws No. 180, item 1860, as amended) in the case of training through the e-learning platform www.znambhp. pl – until the date of validity of the training in accordance with the Regulation of the Minister of Economy and Labor of July 27, 2004 on training in the field of occupational health and safety (Journal of Laws No. 180, item 1860, as amended).) data processed for the purposes of sending the Newsletter – until the consent is withdrawn – by addressing the Principal for this purpose in writing: by e-mail or via the contact form.
  6. The data subject has the right to: request access to their personal data, rectify them, delete them, limit their processing, as well as the right to transfer data, withdraw consent to data processing at any time, which does not affect the lawfulness of processing, which was made on the basis of consent before its withdrawal, lodging a complaint to the President of the Office for Personal Data Protection.
  7. In the event of deletion of the account, all data will be deleted, except for the data necessary for the complaint process and the handling of any claims, which will be stored until the expiry of the limitation periods for claims arising from completed orders.

§ 10 SUBMISSION OF TRAINING DOCUMENTATION

  1. The training documentation will be sent electronically to the address indicated by the Principal in password-protected files. The file decryption password is sent via another information channel, e.g. as an SMS message.
  2. Additional fees will be charged if training documentation is sent by post or courier.
  3. The costs of sending training documentation by post or courier will not be charged for orders over PLN 300.00 net.

§ 11 FINAL PROVISIONS

  1. The participant of the training is not entitled to record the image or sound during the training, unless the Trainer or the Contractor gives prior written consent to the recording of the image or sound.
  2. The organizer has the right to contact both the training participant and the Principal in order to obtain opinions on satisfaction with the quality, form and content of the training.
  3. The Principal agrees to issue an invoice by the Service Recipient without the signature of the person authorized to receive invoices and to send the training documentation by post or e-mail.
  4. If the training Participant is not also the person completing the online registration form, the reporting entity entrusts the Organizer with the personal data of the training Participant for processing in order to conduct the training to the extent necessary for its organization.
  5. The Principal registering the Participant of the training declares that he has read the content of these Regulations and accepts its provisions.
